1. Booking & Payment
1.1 Quotes issued will have 10 days exclusivity, after which other enquiries for the date may proceed.
1.2 A Booking Fee (also called a deposit) is required to secure The Foley Artists for the date of an event.
1.3 By way of making the Booking Fee, the Client is agreeing to the T&Cs laid out below.
1.4 The Booking Fee acts not only as a security fee but also as a pre-payment for the work done by The Foley Artists prior to the event.
1.5 Please note that a booking is not considered 100% confirmed until a Client’s Booking Fee has been received.
1.6 The Foley Artists require the full payment of the Invoice no later than 30 days before the event.
1.7 All payments must be made by way of electronic bank transfer.
2.1 Any cancellations must be made in writing.
2.2 Booking Fees are non-refundable. Please note: Our Booking Fees place a hold on the Client’s date and therefore no other work for that particular date can go ahead.
2.3 If the Client requests to cancel the event more than 30 days before the event, the cancellation fee is the loss of the Booking Fee. If an instalment or balance payment has been made then this will be refunded in full.
2.4 If the Client requests to cancel the event less than 30 days before the event, the cancellation fee is 100% of the event Invoice. Special exceptions can be made in extreme circumstances regarding refund of payments; these will be assessed by The Foley Artists on an individual basis.
2.5 If, in the unlikely event The Foley Artists are not able to perform at the event due to illness, injury, accident, personal or otherwise unforeseen circumstances, all monies will be fully refunded.
COVID-19 SPECIAL CONSIDERATIONS
- Booking Fees paid will be transferable, subject to availability. The Foley Artists will work with the Client to arrange another suitable date.
- No fee is charged to change date due to COVID-19 restrictions.
3) Outdoor events
3.1 The Foley Artists will use their reasonable endeavours to continue an event during an inclement weather event. If the event is located outdoors or partially outdoors, The Foley Artists reserves the right to stop or cancel the event if, in The Foley Artists’ sole opinion, the weather poses a potential danger to The Foley Artists or their equipment.
4.1. The Client is responsible for the conduct of all persons attending the event whether those persons are invited or not. The Foley Artists do not take any responsibility for controlling rowdy behaviour or ejecting unwanted persons from the venue. The Foley Artists have the right to perform in a safe environment.
4.2 The Foley Artists does not tolerate any violent, aggressive or abusive behaviour from any person at a venue where they perform an event. If at any time The Foley Artists feel that their personal safety or the safety of their equipment is under threat then they fully reserve the right to terminate the event at any time. In these circumstances, no refund for the event will be provided and will be forfeited in full.
4.3 By agreeing to these T&Cs, the Client warrants to The Foley Artists that it is responsible to The Foley Artists for any harm caused to The Foley Artists or any of their equipment by any person at the venue hosting the event (whether a guest or otherwise).
5.1 The Foley Artists are not liable in any way for any injuries that may occur due to the actions of the Client and/or any of the Client’s guests. This may include, but is not restricted to drunkenness or other forms of intoxication.
6) Force Majeur
6.1 The Foley Artists are not responsible for any failure to perform any obligation under these T&Cs if its performance has become impossible due to fire, flood, tempest, earthquake, riot, civil disturbance, theft, crime, strike, lockout, breakdown or war.
